Terms of use and sale

1. The service

PopFace Studio lets you create fictional characters ("AI influencers") and generate images, videos, voices and texts featuring them with artificial-intelligence models. Files are archived in your account and can be downloaded. PopFace never publishes anything for you.

AI output can be imperfect or unexpected. You decide whether to use it and you are responsible for what you publish.

2. Account

The service is for adults only. You must provide a valid email address and keep access to your account private. During the beta, access is by invitation.

You can delete your account at any time by writing to contact@popface.fr.

3. Prohibited content

You must not create or try to create: sexual content or nudity; content involving minors in a sexualised or dangerous way; violent, hateful, discriminatory or harassing content; misleading content meant to pass as real facts (fake news, fake evidence); illegal content or content that infringes others' rights.

You must not depict a real person (celebrity or private individual) without their written consent, upload a photo of someone without the right to do so, or pass an AI character off as a real person.

In the editing studio, only import videos, photos and sounds you have the rights to: the people filmed must agree, and protected music (artists, radio, theme tunes) is not allowed without a licence, whatever its length.

Content must follow Instagram, TikTok and YouTube rules (sportswear, swimwear and fashion are allowed within those limits).

If these rules are broken, PopFace may refuse a generation, remove content, suspend or close the account, without refund of credits used. Report content to contact@popface.fr.

4. AI transparency

Generated content is labelled: downloaded images carry an "AI-generated" mark in their metadata, and free-plan images carry a visible watermark. You agree not to remove these marks in order to mislead, and to disclose the AI nature of your character and content when you publish, as EU law and platform rules require.

Videos created or edited with generated images also carry this mark in their metadata. For a commercial post (paid partnership) in France, the notice "Images virtuelles" must be shown when a face or body created with AI appears: the editing studio adds it in one click, and switching it on remains your responsibility.

5. Ownership and use of creations

You keep all rights you hold in what you upload. To the extent allowed by law and by the model providers' terms, PopFace assigns to you any rights it may have in content generated for your account: you may use it, including commercially, on your accounts and media.

You allow PopFace to store and process this material only to run the service. PopFace does not use your creations in its advertising without your consent.

6. Plans, credits and prices

Each generation uses credits according to the rates shown in the app (for example: photo, portraits, HD finish, video). A failed generation does not use credits.

The free plan gives welcome credits once. Paid plans (Creator, Pro, Studio) are monthly or yearly subscriptions, renewed automatically, that grant credits each period. Unused subscription credits expire at the end of the period; credits bought in packs do not expire while the account exists.

Prices are in euros, all taxes included. VAT not applicable, art. 293 B of the French tax code. Payments are processed by Stripe; PopFace never sees your card details.

Promotion codes (including the founder offer) apply under the conditions shown when used.

Referrals: when someone who signed up with your link subscribes to a paid plan for the first time, you get 150 credits and they get 50. Referral credits do not expire and are not refundable. In case of abuse (accounts created to refer yourself, for example), PopFace may cancel them.

7. Right of withdrawal

The service and credits are provided immediately after payment. Under article L221-28 of the French Consumer Code, by confirming your payment you request immediate performance and expressly waive your 14-day right of withdrawal. This is restated on the payment page.

8. Cancellation

You can cancel your subscription at any time from "Plans & credits" > "Manage my subscription". Cancellation takes effect at the end of the current period; no pro-rata refund is due unless required by law.

If a payment fails, the subscription may be paused and then moved back to the free plan.

9. Availability and liability

PopFace does its best to keep the service available and reliable, without guaranteeing it will never be interrupted. AI models are provided by third parties and may change.

PopFace is not responsible for how you use the content, nor for results on social networks (audience, income). Except in case of gross negligence or wilful misconduct, PopFace's liability is limited to the amounts paid in the last 12 months.

11. Changes to these terms

These terms may change. For any significant change you will be told by email or in the app at least 15 days before it applies; you may then cancel.

12. Disputes

These terms are governed by French law. For any complaint, first write to contact@popface.fr. If no agreement is reached, you can use the consumer mediator free of charge: [Médiateur de la consommation à désigner], or the EU online dispute resolution platform. French courts have jurisdiction, subject to consumer-protection rules.
